Turchynov made a statement about the new format of protection against the hybrid war with Russia in an interview with the Interfax-Ukraine news agency, the Obozrevatel reported.
In particular, the head of the NSDC notes that many important tasks have been accomplished within the framework of the ATO. However, military operations in the Donbass have been going on for three years and have outgrown both the duration and the scale of the ATO format.
At the same time, Turchynov reminded that the laws of Ukraine provide two main cases in which the combat use of the Armed Forces can be authorized - the declaration of war and an anti-terrorist operation.
"Despite the popular belief, according to our legislation, the introduction of martial law means only the existence of a special legal regime in the country, or in certain regions, and does not provide an automatic right to use Armed Forces of Ukraine and other military formations," the NSDC secretary said.
Since this legislation was formed on the basis of the old ideas about the classical war and does not take into account the need to resist the hybrid aggression that Moscow leads, it is time to define a new format for Ukraine's defense.
“It is time not only to recognize some regions of the Donetsk and Lugansk regions as occupied but clearly, at the legislative level, to determine the basis of the state policy for their release. An effective technology of protecting the country is needed, and for this, it is necessary to give the president the right to use the Armed Forces and other military formations against hybrid aggression,” Turchynov said.
Also, the Secretary of the National Security and Defense Council stated the need to create a permanent headquarter in the zone of confrontation with wide powers for the integrated management of the AFU and all other law enforcement agencies.
"Such an approach will only strengthen the foundation of the Minsk agreements since their implementation is impossible without resolving security issues and without releasing the occupied Ukrainian territory," Turchynov summed up.
